Vineri seara, ministrul Justitiei a scris pe pagina oficiala de Facebook ca a solicitat GRECO sa transmita si la Ministerul Justitiei comunicatul de presa oficial referitor la „obligativitatea” recomandarilor. Realitatea TV, post care a obtinut punctul de vedere al GRECO, ii raspunde taios.

”Am solicitat la GRECO sa transmita si la MJ comunicatul oficial referitor la ‘obligativitatea’ recomandarilor din recentul raport, despre care se tot vorbeste in presa. Raspunsul primit – ‘Nu exista un comunicat oficial, insa se pare ca a existat o corespondenta electronica la nivel de Secretariat’! In aceste conditii, solicit oricarui detinator sa faca public un astfel de comunicat oficial!”, a scris Tudorel Toader pe Facebook.

Jurnalista Adriana Matei de la Realitatea TV ii raspunde ministrului Justitiei: ” Eu am cerut un punct de vedere oficial de la GRECO si am primit un raspuns de la directorul executiv al GRECO, Gianluca Esposito, transmis de purtatorul de cuvant care se ocupa de Romania. Fac precizarea ca ‘Secretary’ nu inseamna ‘secretar'”.

Domnule Ministru al Justitiei,

Am incercat sa postez raspunsul GRECO pentru Realitatea TV la comentarii, dar sectiunea este inchisa. Gasiti mai jos ce ati cerut. Nu stiu cu cine ati vorbit dumneavoastra. Eu am cerut un punct de vedere oficial de la GRECO si am primit un raspuns de la directorul executiv al GRECO, Gianluca Esposito, transmis de purtatorul de cuvant care se ocupa de Romania.

Fac precizarea ca ,,Secretary” nu inseamna ,,secretar”. As vrea sa pot spera ca stiati ce inseamna. Oricum, daca stiati, inseamna ca deformati adevarul si, daca nu stiati, inseamna ca am gasit deja explicatia pentru diferenta de mesaj pe care o reclamati.

Mi-ar placea sa postati si dvs. documentul la care faceti referire si despre care spuneti ca ar fi diferit de ce am difuzat noi.

Please find below replies to your questions, which you can attribute to Gianluca Esposito, Executive Secretary of GRECO.

GRECO reports are always prepared and adopted in accordance with our Statute and Rules of Procedure. In fact, GRECO is composed of experts appointed by our 49 member States, including Romania. The GRECO team which solely prepared the draft ad hoc evaluation report met all relevant national authorities, including the Minister of Justice, and heard as many different views as possible. The draft report has subsequently been thoroughly discussed and adopted by GRECO as a whole bearing in mind the Romanian authorities’ and all other 48 member States’ views. GRECO evaluators and rapporteurs are designated by member States and they have the necessary level of competence and professionalism to do their work. The team that went to Romania is no exception.

GRECO recommendations are not optional. Our Rules are clear: “Members of GRECO shall comply with the recommendations contained in the evaluation report and implement them fully, within the time limit set by GRECO.” Every GRECO member is required to comply with GRECO’s recommendations. Romania is no exception. GRECO is a monitoring, not an advisory body of the Council of Europe. GRECO has asked Romania to report back at the next plenary in June 2018.

For information, Romania is currently in the non-compliance procedure under GRECO’s 4th evaluation round, after GRECO considered in December 2017 that the very low level of compliance with previous GRECO recommendations relating to corruption prevention in respect of MPs, judges and prosecutors is “globally unsatisfactory” within the meaning of GRECO’s Rules of Procedure.
